Friday, January 18
9 - 11am Concurrent Sessions Affordable
Housing & Redevelopment Issues
David Pasternak, Session Producer
It’s challenging to navigate the waters of managing, let alone selling,
affordable housing projects. If you don’t know how best to communicate and
negotiate with state and local government agencies who are inspecting and
auditing these projects - let alone issuing fines and recording code
violations, this is the breakout session for you. We’ll also discuss the
effect of the abolition of redevelopment agencies on these projects,
including the varied approaches to closing sales by title insurance
companies.
Medical Marijuana Businesses/Facilities
Michael Brumbaugh, Session Producer
This cutting-edge issue, with interesting legal, social and political
implications, vexes commercial landlords every day. Imagine the
complexities when a Receiver is thrown into the equation - and try
explaining the concept to Federal authorities. Practitioners from the
front lines of the battle will provide an update of the current state of
affairs.
Regulatory Receiverships
Kenton Johnson, Session Producer
Fraud may never go out of style completely, but it appears more prevalent
in difficult economic times. The last few years have been busy ones for
the SEC. Join SEC case experienced panelists and a judge for a discussion
of a unique remedy for some of the financial abuses prevalent in the
recent downturn.
11:30 - 12:30pm General Session
Receivership Sales: Statewide Judges’ Panel
Robert Mosier, Session Producer
Practitioners have been debating this topic with fever for the past
several months. This general session will open the curtain on what judges
from around the state think about the various types of sales. Come get the
view from the bench.
1 - 2:15pm Luncheon
Roundtable Hosted Discussions Luncheon
Mike Essary, Session Producer
Judges, panelists, moderators, session producers and other receivership
experts will host the luncheon tables to continue the conversations on a
wide variety of topics. You can participate in several table’s topics or
stay at the same table.
2:30 - 3:30pm General Session
Municipalities
Hannah Blumenstiel, Session Producer
The financial crisis has taken a severe toll on municipalities around the
country, and California cities have been particularly hard hit. Stories of
impending collapse frequent the headlines, and a number of high profile
Chapter 9 bankruptcies have been filed in the past year. This panel will
explore the role a Receiver can play in the process of a municipality
working through financial distress.
4 - 5pm General Session
Ask The Experts
Alan Miram, Session Producer
Put ‘em on the spot! Ask the panel of seasoned receivership professionals
and judges your toughest questions. All topics are open for discussion.
Questions will be asked by text message or email and scrolled on the
screen for panelists to maximize the number of questions we can answer in
an hour.
5 – 6pm
Welcome Reception
Evening free for group social dinners
Saturday, January 19
9 - 11:30am Concurrent Sessions
Ponzi Schemes
Kathy Bazoian Phelps, Session Producer
A working group to explore the top controversies that typically arise in
Ponzi scheme cases as receivers attempt to make defrauded investors whole.
Listen to debate from a panel of experts on the subjects of whether net
winners should be liable to return fraudulent transfers, whether receivers
should be barred by in pari delicto in pursuing tort claims, and how to
establish the methodologies for allowance of investor claims and
distribution schemes in receivership or bankruptcy. Presentations from the
varying viewpoints of the different affected factions, hosted table
discussions, and reports back to the group will make a lively session.
Regulated Health Care Facilities
Krista Freitag, Session Producer
This concurrent session will focus on the unique challenges of running a
regulated health care facility, including patient care, the complex
regulatory frameworks, licensing, third party reimbursement, dealing with
myriad interested parties (family, doctors, community) and financial
challenges.
Substandard Housing - Health & Safety Code
Richardson "Red" Griswold, Session Producer
No matter the economy, there will always be substandard housing issues.
Come share your experiences and work through a hypothetical case covering
complex issues facing these receiverships, including governmental agency
interactions, lender concerns, disgruntled tenants and public safety
issues.
12 - 2:15pm Luncheon
CMBS Panel & Luncheon
Doug Morehead, Session Producer
Lifting the Veil on CMBS - how do you make sense of the commercial
mortgage backed securities system? A panel of key players explains how it
really works, how to get loans modified, when a loan is doomed to
foreclosure and more insights from the players who call the shots.
2:30 - 4:45pm Concurrent Case Studies
Environmental
Mark Cameron, Session Producer
Known and possible toxics? Watershed run off? Lead or asbestos? Adjacent
properties impacts on the property in a receivership? Look at compliance,
monitoring in receivership sales
of properties with significant environmental challenges as the group works
through the hypothetical.
Title & Escrow Issues
Terri Riker, Session Producer
It’s been said that title insurance companies are the final arbiters of a
receiver’s sale, not the court. Working with an evolving hypothetical,
this breakout group will examine the current concerns of title companies,
and discuss how best to tee up a receivership sale to close on time and
with marketable title.
Receivership vs. ABC vs. Bankruptcy
Joel Weinberg, Session Producer
What’s best for the creditor or the debtor? Join our experts in a
hypothetical case discussion that considers which forum is best for the
various parties. As the facts become known, state and federal laws collide
and everyone gets nervous about getting paid, decide what your counsel
would be to the client.
