ABOUT THE SYMPOSIUM
California Receivers Forum in conjunction with Loyola Law School of Los Angeles continues its tradition of educational programming for the professionals involved in receivership. Loyola V is designed for those experienced in receivership matters.

The Symposium is January 18 - 19, 2013 at the Hilton Irvine | Orange County Airport. The hotel is located across from John Wayne Airport and offers a complimentary shuttle.

The 2013 Symposium is redesigned to be interactive and involve everyone in discussions about the nuances of complex cases. It will be lively with debate on sensitive topics and case studies to work through the unique twists of hypothetical cases. You’ll look at the macro and micro aspects of hands on administration of various matters.

Affordable Housing & Redevelopment Issues

It’s challenging to navigate the waters of managing, let alone selling, affordable housing projects. If you don’t know how best to communicate and negotiate with state and local government agencies who are inspecting and auditing these projects - let alone issuing fines and recording code violations, this is the breakout session for you. We’ll also discuss the effect of the abolition of redevelopment agencies on these projects, including the varied approaches to closing sales by title insurance companies.

This cutting-edge issue, with interesting legal, social and political implications, vexes commercial landlords every day. Imagine the complexities when a Receiver is thrown into the equation - and try explaining the concept to Federal authorities. The financial crisis has taken a severe toll on municipalities around the country, and California cities have been particularly hard hit. Stories of impending collapse frequent the headlines, and a number of high profile Chapter 9 bankruptcies have been filed in the past year. This panel will explore the role a Receiver can play in the process of a municipality working through financial distress.

A working group to explore the top controversies that typically arise in Ponzi scheme cases as receivers attempt to make defrauded investors whole. Listen to debate from a panel of experts on the subjects of whether net winners should be liable to return fraudulent transfers, whether receivers should be barred by in pari delicto in pursuing tort claims, and how to establish the methodologies for allowance of investor claims and distribution schemes in receivership or bankruptcy. Presentations from the varying viewpoints of the different affected factions, hosted table discussions, and reports back to the group will make a lively session.

Regulated Health Care Facilities

This concurrent session will focus on the unique challenges of running a regulated health care facility, including patient care, the complex regulatory frameworks, licensing, third party reimbursement, dealing with myriad interested parties (family, doctors, community) and financial challenges.

Substandard Housing - Health & Safety Code

No matter the economy, there will always be substandard housing issues. Come share your experiences and work through a hypothetical case covering complex issues facing these receiverships, including governmental agency interactions, lender concerns, disgruntled tenants and public safety issues.

It’s been said that title insurance companies are the final arbiters of a receiver’s sale, not the court. Working with an evolving hypothetical, this breakout group will examine the current concerns of title companies, and discuss how best to tee up a receivership sale to close on time and with marketable title.
