CRF Delivers Receivership Education to Bankruptcy Professionals

On May 17, 2013, the California Receivers Forum held its annual receivership educational program at the California Bankruptcy Forum Insolvency Conference at Paradise Point Resort in San Diego. The two hour interactive segment featured a lively discussion with Susan Uecker of Uecker & Associates, Inc., Richard Kipperman of Corporate Management, Inc., and Stacy Rubin of Mulvaney Barry Beatty Linn & Mayers LLP. The program was moderated by Robert Mosier of Mosier & Company, Inc. and produced by Everett G. Barry, Jr. of Mulvaney Barry Beatty Linn & Mayers LLP. Sharing their perspectives, the distinguished panel, along with enthusiastic participants, discussed a hypothetical Chapter 11 bankruptcy case involving a receivership over a nine-unit shopping center where the only source of cash flow was rental income generated by the shopping center.

Discussions were centered around the borrower's Chapter 11 bankruptcy filing, turnover, excuse from turnover, relief from stay, and compensation for professional services rendered by a custodian/receiver, attorney or accountant.

Attendees were fortunate to be joined by retired Judge Hargrove from the United States Bankruptcy Court for the Southern District of California and Judge Donovan from the United States Bankruptcy Court for the Central District of California.

The panelists also offered suggestions for legal tools and issues to help guide receivers through the interplay of bankruptcy, such as: knowing your judge and the applicable local and chambers’ rules, along with familiarizing yourself with the order appointing the receiver.
