Receivership Uniform Law Committee Report

By Dunfee, Gordon*

Gordon Dunfee, California Receivers Forum state 2013 Chair and member of the San Diego Chapter, reports some interesting news with potentially far-reaching consequences: On March 7 and 8, 2014, the National Conference of Commissioners on Uniform State Laws held a drafting committee meeting in Salt Lake City, Utah to continue the work on the "Model Act on Appointment and Powers of Real Estate Receivers." In attendance were ULC Observers, Gordon Dunfee and Beverly McFarland, representing CRF. Along with twenty other ULC Commissioners and Advisors, Gordy and Beverly peppered the attendees with their opinions and "in the trenches" experiences on receivership realities. Both left the meeting with the feeling they had made a difference in the effort to create a uniform receivership code. Readers can anticipate a more detailed article on this process to appear in an upcoming edition of Receivership News. The link to the ULC draft is: http://www.uniformlaws.org/Committee.aspx?title=Appointment%20and%20Powers%20of%20 Real%20Estate%20Receivers. Click on "March 2014 Committee Meeting Draft." The ULC Chair encouraged CRF members to review the existing draft and to provide comments. Please send any comments, ideas, or suggestions on how to improve this to Gordon Dunfee at surflaw2@aol.com.
